Terms of Use

Welcome to Rallie! We’re glad you’re here. These are our Terms of Use, it’s basically a form of contract between you and us, so it’s super important that you read them carefully.
To make things easier, we’ve included some TLDR comments (just like this one) – but it’s still important to read the Terms of Use in full, just so you don’t miss anything!
Please make sure the info you give us is valid and true and that you meet your responsibilities under these Terms.
About you
(a) These Terms apply to you as a Rallie User and you warrant that you are authorised to be bound by these Terms.
(b) We try to make Rallie broadly available to everyone, but you cannot use Rallie if:
you are under 18 years old;
you are a convicted sex offender;
you are prohibited from receiving our products, services or software under applicable laws; or
we've previously disabled your account for violations of these Terms or any other terms and policies that apply to your use of Rallie. If we disable your account for a violation of these Terms or other terms and policies, you agree not to create another account without our permission. Receiving permission to create a new account is provided at our sole discretion, and does not mean or imply that our previous action was wrong or without cause.
(c) Currently, you do not have to pay any fees to us to access and use Rallie (of course, we’ll let you know in advance if we plan to change that). However, you are responsible for any charges from your mobile network or internet service provider in relation to your access to and use of Rallie.
(d) As a Rallie User, you are responsible for:
setting up your log in details and password;
giving your account the same name you use in everyday life;
providing accurate, reliable and current information about yourself;
only creating one account (your own); taking security seriously when using Rallie. You must not share your password or allow any other person to access Rallie using your user credentials. You must keep your username and password (or any other access code) secure at all times, as you are responsible for any action performed through Rallie using your user name. If you think someone else may know your password, you should change it immediately and notify us immediately if you become aware of any unauthorised access to or use of your account;
We also want to make sure Rallie is a safe space for everyone, so here’s a quick run down of some things you must (and must not) do when using Rallie.
If something on Rallie makes you feel uncomfortable or unsafe, please let us know.
We want to protect everything that makes Rallie so unique, including its ideas and tech.
When you register an account, we’ll let you use Rallie (as long as you follow the rules), but you won’t own it or be allowed to copy it.
You also need to licence some things to us, such as the content you upload to Rallie.
Intellectual Property
(a) We (or our licensors) retain ownership of all intellectual property rights in and to Rallie, including without limitation the software on which it is based, any documentation regarding its use, text, graphics, video, audio, information, design and layout, and any messages or Content we make available to you (excluding any Content provided by you).
(b) When you sign-up for a Rallie account, we will grant you a non-exclusive, non-assignable and non-transferable licence to access and use Rallie in accordance with these Terms.
(c) This licence is conditional on you complying with:
these Terms or any other terms and policies that apply to your use of Rallie; and
any other reasonable requests made by us, in relation to your use of, and access to, Rallie.
(d) You retain ownership of all intellectual property rights in any Content you share, post or upload to Rallie.
(e) When you share, post or upload Content to Rallie that is subject to intellectual property rights (such as photos or videos), you hereby grant to us a non-exclusive, royalty-free, transferable, sublicensable, worldwide licence to host, use, reproduce, adapt, publicly perform or display such Content. This licence will end when your Content is deleted from our systems.
(f) Rallie may contain trade marks, logos and service names which may be registered or otherwise protected by law. You are not permitted to use any trade marks, logos, service names or trade names appearing on Rallie without our prior written consent.
We’re not responsible for any information contained within links to third party websites or applications as these links are not owned or operated by us
You may find them shared by other Rallie Users, kind of like a detour on a road trip.
Third Parties
(a) Rallie may contain links to other websites or applications, provided by third parties and not owned or controlled by us (Third Party Links)
(b) If you encounter a Third Party Link, it does not imply that we or our licensors endorse them or their content and we make no representations in this regard.
(c) Third Party Links are not covered by these Terms and may have their own terms and conditions and privacy policy. If you choose to access any Third Party Links, you do so at your own risk. We are not responsible for and will not be liable in respect of the content or operation of any Third Party Links.
(d) If you have any queries or concerns regarding the Third Party Links, you should contact the relevant third party provider directly.
We try our best to keep Rallie available and running smoothly, but there may be times when things just don’t go to plan. We’re also not able to guarantee the accuracy or completeness of Content made available on Rallie.
Please keep this in mind when using Rallie!
Availability and accuracy of information
(a) While we use our best efforts to make sure that Rallie is available and operating smoothly, we don’t promise that it will always be accurate or defect free, or that it will be compatible with your device.
(b) We also don’t promise anything in relation to the timeliness, accuracy, suitability, quality or completeness of any Content made available via Rallie.
(c) We are not under any obligation to provide any updates, new releases or maintenance of Rallie. Where an update or maintenance occurs, this may mean that Rallie is temporarily unavailable. Where possible, notification of any planned outages which may impact the availability of Rallie will be provided to you.
The Internet can sometimes be a pretty weird place and while we take the security of Rallie and privacy of our users very seriously, some risks (like hacking) can be outside of our control.
Keep your login details safe and report any security issues or concerns to us ASAP.
Security
(a) We take the security of Rallie very seriously.
(b) We use what we believe to be reasonable security measures to prevent unauthorised use of, or access to information. However, the Internet is not a completely secure environment – you should be aware that information sent by you through the Internet can be accessed, tampered or used in an unauthorised manner by third parties. If you provide us with information via the Internet (including through Rallie), you accept this risk.
(c) We will perform backups at such times and intervals as are reasonable for our business purposes. We do not warrant that we are able to backup or recover specific content or information from any period of time, and you should store any information you might need locally.
(d) You agree that you:
will not do anything to prejudice the security or privacy of Rallie, any Rallie User or any Content on Rallie;
are solely responsible for the security of your login details for accessing Rallie; and
will notify us immediately if you become aware of any unauthorised access to Rallie.
We’ve built the app with all the care in the world and while we think Rallie is pretty awesome, nothing is perfect.
This section explains that we’re not responsible for things outside of our control or if something goes wrong.
If you breach these Terms, you’ll be responsible for any damage this may cause to us or others (including any financial issues!).
Liability and Indemnity
(a) You are solely responsible for determining that Rallie meets your needs and is suitable for the purposes for which it is, or is intended to be, used by you.
(b) To the extent permitted by law:
you acknowledge and agree that the use of Rallie is at your own risk; and
all express or implied guarantees, warranties, representations or other terms not contained in these Terms are excluded.
(c) To the extent permitted by law, we will not be liable for:
any illness, injury, or death resulting from use of Rallie; or
any other any direct or indirect, incidental or consequential damages, loss/corruption of data, or any similar sort of loss resulting from your access to, use of, or inability to use of Rallie or any Content, whether based on warranty, contract, tort, negligence, in equity or any other course of action, and whether or not we knew (or should have known) of the possibility of such a loss.
(d) To the extent permitted by law, you agree to indemnify us for any loss, damage or claim (including the loss or corruption of data, goodwill, bargain, opportunity or anticipated savings) that we may suffer or incur as a result of any breach by you of these Terms.
It would be awful if it came to this, but we may choose to terminate or limit your access to Rallie in certain circumstances, including if we think you haven’t followed these Terms.
Suspension or Termination
(a) We may at any time immediately restrict, suspend or terminate your access to Rallie or any feature of Rallie for any reason (including due to your breach or alleged breach of these Terms or our Community Guidelines) in our sole discretion and without prior notice.
(b) If your account is terminated or we otherwise permanently end your access to Rallie, any data or information we collect about you may be permanently deleted or de-identified.
(c) Termination or expiration of your right to access or use Rallie will not affect any accrued rights, indemnities or any other provisions of these Terms that are intended by their nature to survive termination or expiration.
No strings attached!
While we’ll be sad to see you go, you can delete your Content or leave Rallie anytime you want.
Deleting Content or your Account
(a) You can delete your Content individually or all at once by deleting your Rallie account.
(b) You can delete your Rallie account and discontinue your use of Rallie at any time by selecting the “Delete Account” option from Rallie’s main menu.
(c) If you delete your account, any data or information we collect about you will be permanently deleted or de-identified.

General
Jurisdiction: These Terms are governed by the laws of Victoria, Australia, and we and you each submit to the non-exclusive jurisdiction of the courts of Victoria.
Severability: If any part of these Terms is invalid, unenforceable or illegal, the remaining Terms will continue to apply.
Assignment: You must not assign or novate these Terms (or deal with a benefit or a right under them, in any other way) without our prior written consent, which may be withheld at our absolute discretion. We may novate or assign our rights and obligations under these Terms at any time and without notice to you.
Force majeure: Neither party will be liable by reason of any failure or delay in the performance of its obligations due to events which are beyond the reasonable control of that party (including a failure by a third party provider, pandemic, strikes, shortages, riots, war, terrorism, government action, fires or natural disasters such as floods, earthquakes or hurricanes).
